These Terms of Service ("Terms") govern your access to and use of any services, platforms, applications, or websites operated by DAQ Solutions LLC, doing business as DAQ Works ("DAQ Works," "we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms.
If you are using our Services on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.
DAQ Works provides operations management software, point-of-sale systems, inventory management tools, and related communication services for service-based businesses. Our flagship platform is designed for multi-location service operations and includes features such as digital receipt delivery, inventory tracking, and transaction management.
SMS Consent: By providing your mobile phone number at a DAQ Works-powered point of sale, you expressly consent to receive transactional SMS messages from the applicable business operator. Standard message and data rates may apply. Reply STOP to opt out at any time. Reply HELP for assistance.
DAQ Works provides SMS delivery infrastructure on behalf of client businesses. Transactional SMS messages sent through our platform are limited to service receipts, notifications, and service-related communications directly related to transactions you have initiated. We do not send unsolicited marketing messages via SMS.
Opting Out: You may opt out of SMS communications at any time by replying STOP to any message. Upon receipt of your STOP request, we will send a one-time confirmation and will not send further messages unless you re-initiate contact or re-consent.

All content, software, code, design, and materials comprising the DAQ Works platform are the intellectual property of DAQ Solutions LLC and are protected by applicable copyright, trademark, and trade secret laws. Nothing in these Terms grants you a right or license to use any of our intellectual property except as necessary to use the Services as intended.
DAQ Works licenses its platform to client businesses ("Operators"). If you are an end user interacting with a DAQ Works-powered system operated by a third-party Operator (such as an auto repair shop or service business), your primary service relationship is with that Operator. DAQ Works is not responsible for the services, products, or conduct of Operators.
Operators are required to comply with applicable laws, including consumer protection regulations, and to obtain appropriate consent before initiating communications with their customers.
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. DAQ WORKS DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DAQ SOLUTIONS LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED $100.
You agree to indemnify, defend, and hold harmless DAQ Solutions LLC and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services or violation of these Terms.
We reserve the right to suspend or terminate your access to the Services at any time for any reason, including violation of these Terms, without notice or liability. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination will survive, including intellectual property rights, disclaimers, and limitations of liability.
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Services shall be resolved exclusively in the state or federal courts located in Dallas County, Texas, and you consent to personal jurisdiction in those courts.
We may update these Terms at any time. We will notify you of material changes by posting the updated Terms on this page. Continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
